Many District and school administrators are unclear how to blend federal Title IX law with California student discipline laws. All it takes is one sexual harassment suspension or expulsion to learn the hard way. This presentation covers basic requirements under Title IX for investigations, student discipline, due process, and student protections, while at the same time explaining how to issue legal discipline under the Education Code. We will review a specific Title IX case study on sexual battery that led to a valid student expulsion in California. Ms. Fichtner has over 23 years of experience practicing Education Law related to sexual harassment, sexual violence, and student discipline in k-12 and colleges in California.
